These Website Terms and Conditions govern the ordering, sale and delivery of Goods, and the use of this Website.

1. Detailed description of goods and/or services

Classic Namibian Delicatessen is a butchery delicatessen business in the food industry that sells a large selection of meat cuts, delicatessen and related products (“Goods”). This Website enables you to shop online for a range of fresh meat, poultry and related products including beef, steak, pork, lamb, game and chicken.

This website can be accessed at namdeli.co.za, (the “Website”) and is owned and operated by Classic Namibian Delicatessen (Pt) Ltd (“Classic Namibian Delicatessen”, “namdeli.co.za”, “we”, “us” and “our”). These Website Terms and Conditions (“Terms and Conditions”) govern the ordering, sale and delivery of goods, and the use of this Website.

These Terms and Conditions are binding and enforceable against every person that accesses or uses this Website (“you”, “your” or “user”), including without limitation each user who registers as users on the Website (“registered user”). By using the Website or by clicking on the “Sign Up” or “Register” or “Log In” buttons on the Website, you acknowledge that you have read and agree to these Terms and Conditions.

2. Availability of Stock

Users or Registered users may place orders for goods which Classic Namibian Delicatessen may accept or reject. Whether or not Classic Namibian Delicatessen accepts an order depends on the availability of goods, the correctness of the information relating to the goods (including without limitation the price) and receipt of payment or payment authorisation by Classic Namibian Delicatessen for the goods.

We may decide to offer discounted Goods for specific periods on the Website (“Specials”). However, Specials have a stock limit and may expire earlier if stock runs out. We will reserve stock for customers in the order in which we receive payment.

You acknowledge that stock of all products on offer is limited and that pricing may change at any time without notice to you. Classic Namibian Delicatessen will take all reasonable efforts to monitor stock levels and ensure that when stock is no longer available, that offers thereof are discontinued or shown as “out of stock” or “sold out” on the Website. However, we cannot guarantee the availability of stock. When goods are no longer available after placing an order, Classic Namibian Delicatessen will notify you. You will be entitled to a refund of the amount paid by you or select an alternative product of similar value.

Placing products in a shopping basket without completing the purchase cycle does not constitute an order for such products, and as such, products may be removed from the shopping basket if stock is no longer available or the price thereof might change without notice to you. You cannot hold Classic Namibian Delicatessen liable if such products are not available or are not available at a particular price when you complete or attempt to complete the purchase cycle at a later stage.

NOTE: The pricing of our meat products is based on p/kg mass in 500g or 1kg measures. Classic Nambian Delicatessen shall take all reasonable steps to cut meat as close to the total p/kg mass ordered. Our orders are cut specifically on instruction. As a result, some orders may not match the exact p/kg mass on your order. We will try and match it as close as possible to the total mass ordered.

3. Delivery policy

Classic Namibian Delicatessen will indicate the acceptance of your order by delivering the products to you or allowing you to collect them, and only at that point will an agreement of sale between you and Classic Namibian Delicatessen come into effect (the “Sale”). This is regardless of any communication from Classic Namibian Delicatessen stating that your order or payment has been confirmed.

We offer customers a choice of (two) methods of delivery of products to you. You may choose to self-collect or via Classic Namibian Delicatessen’s own delivery service.

Subject to availability and receipt of payment, requests will be processed as soon as reasonably possible within, but no later than 3 (three) days (“Delivery Period”). Delivery will be confirmed by way of email or WhatsApp confirmation (for e.g. order confirmation/booking voucher etc. and mention delivery and associated costs, where applicable.) We will notify you if we are unable to deliver the Goods during the Delivery Period. You may then, within 2 (two) days of receiving such notification elect whether or not to cancel your order for the products. If you elect to cancel your order, we will reimburse you for the purchase price.

Classic Namibian Delicatessen’s obligation to deliver a product to you is fulfilled when we deliver the product to the physical address nominated by you for delivery of the order. Since we are working with fresh meat products, customers must ensure they have an area to keep the products in a refrigerator at the time of delivery. Classic Namibian Delicatessen is not responsible for any loss or unauthorised use of a product after it has delivered the product to the physical address nominated by you. You acknowledge that most products delivered by Classic Namibian Delicatessen are of a perishable nature and require refrigeration as soon as possible after delivery.

4. Export restriction

The offering on this website is available to South African customers only. Deliveries are only available within the main metropolitan areas in the Western Cape.

5. Return and Refunds policy

The provision of goods and services by Classic Namibian Delicatessen is subject to availability. In cases of unavailability. Classic Namibian Delicatessen will provide an alternative product suggestion or refund the customer in full within 30 days. Cancellation of orders by the customer will require a 5 % administration fee.

6. Policy regarding Damaged goods

Classic Namibian Delicatessen will not take any responsibility for goods that have been damaged as a result of not taking proper care of them or non-refrigeration.

7. Customer Privacy policy

Classic Nambian Delicatessen shall take all reasonable steps to protect the personal information of users. For the purpose of this clause, “personal information” shall be defined as detailed in the Promotion of Access to Information Act 2 of 2000 (PAIA). 8. Payment options accepted

We are committed to providing secure online payment facilities. All transactions are encrypted. Once you have selected your payment method and you accept these Terms and Conditions, you will be directed to a link to a secure site for payment of the applicable purchase price for the products.

Payment may be made via Visa and MasterCard, EFT or cash on delivery. Where payment is made via credit card, we may require to verify the validity of payment. As such we are entitled to withhold delivery until authorisation is obtained. You must be fully authorised to use the credit card supplied for the purpose of paying the products ordered. Also, your credit card has sufficient funds available to cover all the costs incurred from your order.

Payment made via direct bank deposit or electronic funds transfer: Classic Namibian Delicatessen will not accept orders if payment was not received. If you pay via direct bank deposit or electronic funds transfer, payment must be made within 3 (Three) hours of placing your order.

9. Card acquiring and security

Card transactions will be acquired for Classic Namibian Delicatessen via PayGate (Pty) Ltd who are the approved payment gateway for all South African Acquiring Banks. PayGate uses the strictest form of encryption, namely Secure Socket Layer 3 (SSL3) and no Card details are stored on the website. Users may go to www.paygate.co.za to view their security certificate and security policy.

10. Customer details separate from card details

Customer details will be stored by Classic Namibian Delicatessen separately from card details which are entered by the client on PayGate’s secure site. For more detail on PayGate refer to www.paygate.co.za.

When you visit the Website or send emails to us, or sign up to our newsletter, you consent to receive communications from us electronically in accordance with our privacy policy.

This Website may contain links or references to other websites (“Third Party Websites“) which are outside of our control, including those of advertisers. These Terms and Conditions do not apply to those Third Party Websites and Classic Namibian Delicatessen is not responsible for the practices and/or privacy policies of those Third Party Websites or the “cookies” that those sites may use.

Notwithstanding the fact that the Website may refer to or provide links to Third Party Websites, your use of such Third Party Websites is entirely at your own risk and we are not responsible for any loss, expense, claim or damage, whether direct, indirect or consequential, arising from your use of such Third Party Websites or your reliance on any information contained therein.

At any time, you can choose to stop using the Website, with or without notice to Classic Namibian Delicatessen.

11. Merchant Outlet country and transaction currency

The merchant outlet country at the time of presenting payment options to the cardholder is South Africa. Transaction currency is South African Rand (ZAR).

These Terms and Conditions and our relationship and/or any dispute arising from or in connection with these Terms and Conditions shall be governed and interpreted in accordance with the laws of the Republic of South Africa.

The contents of the Website, including any material, information, data, software, icons, text, graphics, layouts, images, sound clips, advertisements, video clips, trade names, logos, trade-marks, designs and service marks which are displayed on or incorporated in this Website (“Website Content”) are the property of Classic Namibian Delicatessen, its advertisers and/or sponsors. Any use, distribution or reproduction of the Website Content is prohibited unless expressly authorised in terms of these Terms and Conditions or otherwise provided for in law.

13. Responsibility

Classic Namibian Delicatessen takes responsibility for all aspects relating to the transaction including sale of goods and services sold on this website, customer service and support, dispute resolution and delivery of goods.

Classic Namibian Delicatessen shall not be liable for any direct, indirect, incidental, special or consequential loss or damages which might arise from your use of the website or your inability to use the website, and/or unlawful activity on the website and/or any linked third party website. You hereby indemnify Classic Namibian Delicatessen against any loss, claim or damage which may be suffered by yourself or any third party arising in any way from your use of this website and/or any linked third party web

Classic Namibian Delicatessen may in its sole discretion terminate, suspend and modify this Website, with or without notice to you. We will use reasonable endeavours to maintain the availability of the Website, except during scheduled maintenance periods, and are entitled to discontinue providing the Website or any part thereof with or without notice to you.

Classic Namibian Delicatessen may, in its sole discretion, at any time and for any reason and without prior written notice, suspend or terminate the user’s right to use the Website or any of its contents subject to us processing any orders already made by you. If you fail to comply with your obligations under these Terms and Conditions, including any incident involving payment of the price of an order for any Goods, this may (in our sole discretion with or without notice to you) lead to a suspension and/or termination of your access to the Website without any prejudice to any claims for damages or otherwise that we may have against you.

Classic Namibian Delicatessen is entitled, for purposes of preventing suspected fraud and/or where it suspects that you are abusing the Website and/or have created multiple user profiles to take advantage of a promotion or Coupon intended by Classic Namibian Delicatessen to be used once-off by you, to blacklist you on its database (including suspending or terminating your access to the Website), refuse to accept or process payment on any order, and/or to cancel any order concluded between you and Classic Namibian Delicatessen, in whole or in part, on notice to you.

We may in sole discretion, change any of these Terms and Conditions at any time. It is your responsibility to regularly check these Terms and Conditions and make sure that you are satisfied with the changes. Should you not be satisfied, you must not place any further orders on, or in any other way use, the Website.
